Pennsylvania Rules for Projected Release

Pennsylvania does not use a verified blanket rule that every state prisoner serves 85 percent of a sentence. It also does not provide an automatic good-time reduction for all state inmates. Under 42 Pa.C.S. § 9756, a court imposing total confinement states a maximum term and generally sets a minimum no greater than half of that maximum. The minimum is usually the first point at which parole may be considered. It is not an order for release.

Under 61 Pa.C.S. § 6137, the Pennsylvania Parole Board exercises parole authority within statutory limits. The Board may grant or deny parole based on the case and governing law. A denial, unresolved detainer, misconduct issue, program requirement, incomplete home plan, new sentence, or recalculation can keep a person confined beyond the minimum date and up to the controlling maximum.

Indiana County RRRI Release Eligibility

The Recidivism Risk Reduction Incentive is a specialized state-sentence program, not ordinary good time. Under 61 Pa.C.S. §§ 4503 and 4505, eligibility has significant exclusions and requires the court and statute to apply. For a qualified person, the RRRI minimum is generally three-fourths of a minimum sentence of three years or less, or five-sixths of a longer minimum.

That calculation creates an earlier parole-eligibility point under RRRI rules. It does not compel the Board to release the person on that date. A release from one institution may still be a transfer. If Indiana County Jail reports that someone left for PA DOC, another county, federal custody, treatment placement, or immigration custody, search the named receiving system. Do not call the transfer date a full release.
